Terms of Service

The agreement between you and Hepworth Digital Ltd when you use Auto Ascension services.

01About us

These Terms of Service ("Terms") govern your use of Auto Ascension services, operated by Hepworth Digital Ltd, a company registered in England and Wales (company number 16194921). Registered office: 25 Raby Drive, Moreton, Wirral, United Kingdom, CH46 0TJ. By accessing or using our services, you agree to these Terms.

02Services provided

We provide website design, custom CRM software, hosting, digital marketing, review management, lead generation, and related services to businesses in the United Kingdom. The exact services provided to you will be set out in your individual service agreement.

03Payment terms

All build fees are due upfront before work commences. Monthly retainers are billed in advance on the same calendar date each month. Payment is processed via Stripe (or Paddle, as applicable). Failure to pay within 14 days of the due date may result in service suspension.

04Refunds

Our refund policy is set out separately in our Refund Policy. In summary: build fees are non-refundable once work has commenced. Monthly retainers are covered by a 90-day money-back guarantee — see /refunds for full details.

05Client obligations

You agree to:

  • Provide accurate information;
  • Respond to our reasonable requests for content, approvals, or information within 5 working days;
  • Comply with all applicable laws when using services we provide;
  • Not use our services for any illegal activity, including unsolicited marketing in breach of UK GDPR or PECR.

06Intellectual property

All work we create for you (websites, CRM customisations, content) becomes your property once paid for in full. Our underlying software platforms, templates, and codebase remain our intellectual property. You receive a non-exclusive licence to use our platforms while your subscription is active.

07Data protection

We are a data processor for any customer data you store in our CRM. We process this data in line with the UK GDPR and the Data Protection Act 2018. Full details in our Privacy Policy.

08Service availability

We aim for 99.5% uptime on hosted services. Planned maintenance will be notified in advance where possible. We are not liable for downtime caused by third parties (e.g. hosting providers, payment processors).

09Termination

You may cancel your monthly retainer at any time after the first 90 days. We may terminate services with 30 days notice for any reason, or immediately for breach of these Terms. On termination, you may export all your data.

10Limitation of liability

To the maximum extent permitted by law, our total liability to you is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect or consequential losses (lost profit, lost data, etc.).

11Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
